Terms And Conditions For Bloom Farms Wild Meadow Flowers Website.
These terms and conditions (the "Terms and Conditions") are the terms and conditions upon which Bloom Farms ("we/us") make this website (the “Bloom Farms Site") available to you.
These Terms and Conditions Govern Your Use Of The Bloom Farms Site.
1.1 All products as depicted on this website (as may be varied from time to time) are available for local delivery and nationwide overnight delivery.
1.2 Certain flower and plant products may be delivered in bud to ensure longer life.
1.3 All products are subject to availability. In the event of any supply difficulties, we reserve the right to substitute with a product of equivalent value and quality without notice.
1.4 In the event that we are unable to supply all or part of your order (the product or any substitute product to you at all), we shall notify you as soon as possible and reimburse your payment in full no later than 30 days after the intended delivery date.
1.5 Cut floral products labeled Same Day Bouquets on the Bloom Farms Website are available for same day local Shelby County TN delivery with a standard fee of $10.00. Exception being if the product is labeled free delivery in the 901 on the product description. This fee could vary up and down due to location. Please contact us directly at 901-308-3026 for questions regarding this service to all of our 901 customers.
2.1 Prices listed within the Bloom Farms website are valid for a maximum of 14 days from the day of ordering, but are subject to change during peak periods and to accommodate the seasonal availability of some flowers.
2.2 Unless stated at checkout,prices do not include TN State Sales Tax and local or national delivery charges.
2.3 Product prices exclude the local delivery charge unless otherwise stated at checkout.
2.4 We reserve the right to change without notice, the price, or prices of any, or all products listed on the Bloom Farms Website.
3. Orders / Payment
3.1 During the order process, you will be required to provide us with your complete personal details, including accurate zip code, together with those of the intended recipient and all necessary payment details.
3.2 We accept payment by all major credit and/or debit cards. PayPal is accepted as well.
3.3 By clicking on the 'check out' button at the end of the order process, you are consenting to be bound by our terms and conditions contained in these Terms and Conditions and appearing anywhere on the Bloom Farms Website.
3.4 Submitting your order is subject to our acceptance of this offer. We will send an email confirmation of your order details to advise that we are processing your order via the email address you provided. We will not consider ourselves bound by a contract with you until we have issued this email confirmation.
4.1 Except where stated, standard procedure in shipping of our live potted plants promises an order ship date of 3-5 days after the order is received. Usually much sooner. We promise to deliver thriving plants ready for your home or garden, Accompanied by our 7 Days Meadow To Mantle Freshness Guarantee!
4.2 Except where stated, Standard Delivery is next day, on all cut floral deliveries and a standard delivery charge of $10.00 will be applicable within the Shelby County TN area. Certain locations will be charged at a higher or lower amount than the standard delivery charge.
4.3 Selected products are not available for delivery to certain areas when possible we will advise you of these restrictions before you place your order.
4.4 Delivery Services - Should you require your delivery to be made same day or within a specific time period please call 901-308-3026 to place your order. Same day Floral orders Inside the 901 have a 12:00 PM cut off time.
4.5 Your intended delivery date will be confirmed in your email order confirmation. We may process orders received on Sundays or Public Holidays the next working day.
4.6 Delivery is not available on Sundays or public holidays, orders will be delivered on the next working day.
4.7 To avoid problems or delays with delivery, please ensure that you have included the full address details, including accurate Zip Code of the intended recipient and telephone number, together with your daytime contact telephone number and e-mail address so that we can notify you in the event that any delivery problems are encountered.
4.8 In the case of delivery to certain locations, where a third party is involved, such as offices, hospitals, Funeral Directors, and other business locations, the signature of any person authorized to accept delivery on behalf of the Organization shall be accepted as proof of delivery to your chosen recipient.
4.9 Please note that Bloom Farms is only responsible for delivering to the address you quote (or to a neighbor if no one is at home). Please advise us during the ordering process.
4.10 Where the delivery driver is unable to find someone to accept delivery they will deliver to a neighbor, leave in a secure location, or leave a card for the recipient to make contact with Bloom.
4.11 In the instance there are any difficulties in delivering your order to the intended recipient, we reserve the right to contact the recipient using the contact details you provide at the time of placing your order.
4.12 Before placing your order, please give us a call if you have any questions or concerns.
5.1 Orders may be amended or cancelled up to 3 working days before the intended delivery date.
5.2 To amend or cancel your order, please contact Bloom Farms between the hours of 8:00 AM to 5:00 P.M. Monday - Friday and 8:30 AM to 1:00 PM on Saturday. Please use the contact details set out in Section 6 below.
5.3 Orders may not be canceled on or after the requested order delivery date.

6.2 Because of the perishable nature of most products, and in order to assist us in resolving any complaints quickly and to our mutual satisfaction, we advise you to contact us within 1 working day of the date of delivery or intended delivery of your purchase.
Whilst we agree to use all reasonable procedures to ensure that the Bloom Farms Website is fully operational and error-free at all times, we cannot guarantee acceptance or responsibility for interruption of the Bloom Farms Site in the event of any situation beyond our reasonable control, which renders the provision of the Bloom Farms Site impossible or impractical .
8.1 We reserve the right to supplement and amend the Terms and Conditions on which you are permitted access to the Bloom Farms Site and/or the Bloom Farms delivery service from time to time. We will update any changes on the Bloom Farms Site and it is your responsibility as a customer to review the Terms and Conditions on each occasion you access the Bloom Farms Site. Changes will be effective immediately after the posting of any such change and all subsequent dealings between you and us shall be on the new terms and conditions.
8.2 We reserve the right to suspend, restrict or terminate access to the Bloom Farms Site at any time.
8.4 A person who is not a party to the agreement between you and us has no rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any of the Terms and Conditions but this does not affect any right or remedy which exists apart from that Act.
8.5 In respect of fraudulent misrepresentation, this agreement (including any documents and instruments referred to herein) supersedes all prior representations, arrangements, understandings, and agreements between you and us (whether written or oral) and sets forth the entire agreement and understanding between you and us relating to the subject matter hereof.
8.6 These Terms and Conditions shall be governed by and construed in accordance with the Courts of the United States of America.
